DO I REALLY NEED AN ATTORNEY TO SETTLE MY CASE?

Yes. However, by law you cannot be represented by an attorney in small claims court and you are only allowed to seek a maximum of $10,000.00. However, you should always talk with an attorney before making this decision. If you file in small claims court on the property damage claim and don’t make the appropriate indications in your paperwork, you may later be prevented from pursuing your claim for personal injuries in a separate lawsuit.

Nothing up front.  At Child & Jackson we never require our clients to pay us a retainer or to cover case costs.  We only get paid if the client gets paid. That means that we will only be paid if and when we settle the case. Additionally, we guarantee that our attorney’s fees will never be more than what our client receives in his or her pocket from the settlement.

HOW LONG WILL IT TAKE FOR MY CASE TO SETTLE?

That depends on a lot of things. However, we will only proceed to settle your case once we know that we can obtain the maximum value for your case. While every client would like to settle their case as soon as possible, settling a case too soon will not benefit anyone, especially the client. Most clients treat their injuries for a period of time, after which we gather all of the necessary medical and other related documentation to support our case and we use that to make our case and strengthen our position. If we are then able to agree with the insurance company for the at-fault party on a settlement that is fair and just for our client then we do so. However, if we cannot then we proceed with litigation, or in other words we file a lawsuit in court and proceed as if we will be going to trial. So, the length of a case depends on many different factors, but we will do all we can to expeditiously finalize your case with the goal of getting you the best results allowable under the law.
