Commercial Truck Accidents

Commercial Truck Accidents [Big Rigs]

Commercial trucks usually have a tractor and trailer and are commonly referred to as "Big Rigs," carrying payloads that can be dozens of tons. Due to the colossal size and weight of these trucks, these accidents can be catastrophic when they impact a normal car or motorcycle. Some common issues in these cases are as follows:

COMMERCIAL TRUCKS HAVE BLIND SPOTS, ESPECIALLY WHEN MERGING AND TURNING:  Commercial trucks have serious blind spots due to their size. While they are equipped with multiple mirrors to allow full view as much as possible on both sides, in practice it is much harder to capture all adjacent vehicles at all times before merging or turning. Even seasoned commercial drivers will miss small vehicles and motorcycles from time to time.

COMMERCIAL TRUCKS ARE COLOSSAL VEHICLES THAT ARE ENORMOUSLY HEAVY, SOLIDLY BUILT, AND HAVE TERRIBLE DESTRUCTIVE CAPACITY IN AN ACCIDENT:  An 18-wheel commercial tractor and trailer [fully loaded] can weigh as much as 80,000 pounds. The force involved in even a minor collision can be enough to cause deadly injuries to the human body, even in parking lots. Commercial trucks are solidly built, so even when they seem to have little or even damage [a scratched and slightly dented bumper for example], you may still see extensive crush damage to smaller cars and trucks.

COMMERCIAL TRUCKS USUALLY HAVE VIDEO RECORDINGS IN THE CAB THAT ARE SAVED AFTER THE COLLISION:   Many commercial truck logistics companies have, as a standard practice, video recordings in the cab of the tractors where you can see the driver from the cab's point of view, as well as the speed on the video display. This needs to be secured by your attorney immediately, and if it is destroyed, be properly presented to a jury as to the reason for its destruction.

COMMERCIAL TRUCKS HAVE PROTOCOLS FOR ACCIDENT REPORTING:  Most trucking companies have reporting protocols for accidents, and obtaining that information and data early to assure that it is preserved is essential in any trucking case. Having that information may give clues to establishing not only liability (fault) but causation of injuries and damages as well.

COMMERCIAL TRUCKS CASE OFTEN INVOLVE EXPERTS: Because commercial trucks involve cases where special commercial driver licenses are involved, in cases where there is a contested liability, it is critical to retain high-quality experts to ensure that the insurance carriers and defense attorneys do not exploit defenses that, in reality, have no merit. Child & Jackson has been representing clients in trucking accidents for over two decades, including many contested liability cases, and has prevailed with substantial settlements for our clients.
