Motorcycle Accidents


Motorcyclists are some of the best drivers on the road, but frequently drivers of cars or trucks fail to see them and pull out in front of them or merge into their lane suddenly without any warning, causing serious or even catastrophic injuries in many cases. Below are some common legal and factual issues related to motorcycle accidents:

MOTORBIKES AND OTHER TWO-WHEELED VEHICLES [ELECTRIC BIKES/ELECTRIC SCOOTERS/MOPEDS] CANNOT STOP QUICKLY WHEN CONFRONTED WITH DANGER:  Due to the physical nature of two-wheeled vehicles, when they are cut off they cannot avoid a collision when someone suddenly pulls out in front of them, or turns or merges into their lane. Usually, the options are either turn as much as possible before laying down the motorbike and then try to slide behind it to avoid a direct collision with the car/truck that cut the motorcyclist off. If they do not, they will strike the car or truck head-on, and be thrown directly into, or over, the car or truck, causing an even more serious injury or even death. Because of this, often you see accidents where a motorcyclist is cut off and swerves to one side or the other, even into the shoulder or oncoming lane, before laying down their bike and either hitting or missing the car or truck that cut them off. This inevitably causes extensive abrasions (depending on what they are wearing), contusions, and depending on the speed, serious fractures, and head trauma, even when wearing a helmet. The forces involved with even a 10 mph collision on a motorcycle are extremely dangerous to any human body, and will almost always cause significant, if not catastrophic injuries depending on the speed, angle, and conditions where the motorcycle accident occurred.     

 

TRUCK/ CAR DRIVERS OFTEN PULL INTO INTERSECTIONS WITHOUT SEEING A MOTORCYCLE, WHICH A MOTORCYCLIST CANNOT AVOID:  Motorcycles are often overlooked by drivers of cars and trucks, and it is not uncommon for them to state that the motorcycles "came from nowhere" when they pull into an intersection or roadway thinking it is clear. As stated above, in these cases the motorcyclist has little choice but to strike the vehicle or lay down their motorbike, often suffering extremely serious injuries.
